Who we are

PONCHI is a product of Chimera Brands LLC. This notice explains what information we collect when you visit ponchi.us, why, and the choices you have. If you have questions, email crayon@ponchi.us.

Information we collect

• You give us: your email when you request a discount or contact us, and any details you share when placing an order (such as name, shipping address, and the artwork you upload).
• Collected automatically: basic device and usage data (like pages viewed and general location from your IP) through cookies and similar technologies, to keep the site working and understand how it's used.
• Children's artwork: orders are directed to and controlled by adults. We aim to collect only what's needed to create, deliver, and support an order, and we do not sell children's information.

How we use it

• To run the site, process and deliver orders, and provide support.
• To remember your preferences and improve the experience.
• To send offers and updates you've asked for (you can unsubscribe anytime).
• To measure site performance and, where permitted, support our marketing.

Cookies & similar technologies

We use cookies that are necessary for the site to function, plus optional ones for analytics and marketing. You can control optional cookies through your browser and through the choices below.

Sharing

We share information with service providers who help us operate (for example, hosting, payments, and shipping), and where required by law. We do not sell your personal information for money. Depending on how "sale" and "sharing" are defined under your state's law, certain analytics or advertising cookies may be considered "sharing" — you can opt out below.

Use the controls below to opt out of optional analytics and advertising technologies. Necessary cookies can't be turned off because the site needs them to work.

Your rights

Depending on where you live, you may have the right to access, correct, or delete your personal information, or to opt out of certain uses. To make a request, email crayon@ponchi.us and we'll respond as required by applicable law.

Children’s information

This matters more here than on most websites, because what we make begins with a child’s drawing. So we want to be exact about it.

PONCHI is sold to adults. The Site, the ordering flow and the checkout are directed to parents, guardians and adult gift-givers — not to children. We do not offer child accounts, and a child cannot place an order, create a login, or buy anything from us.

Information about a child reaches us from the adult, not from the child. When you upload a drawing or a photograph and tell us a child’s first name, you are providing that information to us as the responsible adult. We ask for the least we need to make and deliver the piece and to put the right name on a certificate or passport. We do not ask children for personal information, and we do not knowingly collect personal information directly from a child under 13 in a way that would require verifiable parental consent under the Children’s Online Privacy Protection Act (COPPA).

Our mini-games. The PONCHI games are played by children, and that is the point of them. The games do not ask a player to register, and we do not build profiles of players. Where a game offers to email something — for example, to unlock a replay — that prompt is intended for a parent or guardian to complete. If an email address belonging to a child reaches us this way, treat it as something you can have removed: email us and we will delete it.

We never do these things with a child’s information. We do not sell it. We do not share it for anyone else’s advertising. We do not use it for behavioural or targeted advertising, to a child or to anyone else. We do not use a child’s drawing, photograph, likeness or name in marketing without separate, specific, written permission from the adult on the order — buying a PONCHI is not that permission.

If you believe we hold information about your child that we should not, email crayon@ponchi.us. We will confirm, delete it, and tell you what we deleted. You do not need an account or an order number to ask, and we will not charge you for it.

How long we keep things

• Order records — while your order is live and afterwards for as long as tax, accounting and warranty obligations require, which in Texas is ordinarily at least four years.
• Artwork and photographs you upload — while we make your piece, and afterwards so that we can remake it if it arrives damaged or is lost. Ask us to delete your uploads at any time once your order is complete and we will.
• Digital Passport and Time Capsule content — as described in section 13 of the Terms of Sale: for as long as we operate the service, with at least 90 days’ notice and an export if we ever discontinue it.
• Marketing email — until you unsubscribe, which you can do from any email we send.
• Analytics — in aggregated or de-identified form, which is not linked back to you.

How we protect it

Payments are processed by Stripe; we never see or store your full card number. The Site is served over HTTPS. Access to order records and uploads is limited to the people who need it to make and ship your order. No method of transmission or storage is perfectly secure, and we will not pretend otherwise — but if a breach ever affects your personal information, we will notify you and the Texas Attorney General as required by Texas Business & Commerce Code §521.053.

If you live in Texas

Under the Texas Data Privacy and Security Act you may ask us to confirm whether we process your personal data, to give you a copy of it, to correct it, to delete it, and to opt you out of targeted advertising, sale of personal data, or profiling with legal effects. We honour these requests from Texas residents whether or not we are required to, and we do not charge for them or treat you differently for asking.

How to ask: email crayon@ponchi.us with what you want done. We will respond within 45 days, and may extend once by a further 45 days if the request is complex, telling you why before we do.

If we say no: you may appeal by replying to our decision. We will review the appeal and give you a written answer within 60 days. If we deny the appeal, we will tell you how to complain to the Texas Attorney General at texasattorneygeneral.gov.

Residents of other states with comprehensive privacy laws may have comparable rights; email us and we will apply whichever gives you more.

Changes to this notice

If we change this notice we will update the date at the top. If a change materially affects how we use information you have already given us, we will tell you by email before it takes effect.
